1. Application of the Terms

These Terms of Service (“Terms”) govern the use of the iOS application StillFlow (“the App”) provided by RINPA (“the Company”).

The App is also subject to Apple’s Licensed Application End User License Agreement (Apple EULA).

If these Terms conflict with the Apple EULA, the Apple EULA shall prevail.

2. Conditions of Use

  1. You must be 13 years of age or older to use the App.
  2. By using the App, you agree to these Terms and the Apple EULA.
  3. The features and specifications of the App may be changed, suspended, or discontinued without prior notice.
  4. The App provides functionality such as photo import, particle animation effects, face detection via Apple’s Vision framework, single-shot capture, burst capture, and video recording. Performance and results may vary depending on your device.

3. Prohibited Conduct

You shall not engage in any of the following:

  1. Acts that violate laws or public order and morality.
  2. Reverse engineering, decompiling, disassembling, or any similar analysis of the App.
  3. Use of the App for unlawful or fraudulent purposes.
  4. Infringement of the rights or interests of the Company or third parties (including intellectual property rights, privacy rights, and publicity rights).
  5. Use of the App or exported media (images or videos) for illegal, harmful, or inappropriate content creation or distribution.
  6. Any other acts deemed inappropriate by the Company.

4. Intellectual Property Rights

  1. All intellectual property rights related to the App, including but not limited to design, UI, code, particle algorithms, and images, belong to the Company or authorized rights holders.
  2. Images and videos generated using the App (“Exported Content”) belong to the user. However, the user must ensure that such content does not infringe the rights of third parties.
  3. You may not reproduce, distribute, modify, or redistribute any part of the App beyond what is permitted under applicable law or the Apple EULA.

5. Disclaimer

  1. The Company shall not be liable for any damages arising from the use of the App except in cases of intentional misconduct or gross negligence.
  2. The Company does not guarantee the availability, accuracy, performance, suitability, or functionality of the App.
  3. The particle animation results and face detection accuracy may vary by device and operating environment.
  4. Differences between the Free version and the Pro version (e.g., watermarks, export limits, particle count limits) are part of the specification and do not constitute defects.

6. Limitation of Liability

If the Company is found liable for damages notwithstanding the Disclaimer,

the Company’s total liability shall be limited to 10,000 JPY, and only for direct and actual damages.

The Company shall not be liable for lost profits, indirect damages, special damages, or consequential damages.

7. Analytics (Firebase Analytics)

  1. The App uses Firebase Analytics to understand usage patterns, improve features, diagnose issues, and evaluate in-app purchase performance.
  2. Firebase Analytics may collect non-personally identifiable data such as device information, in-app interactions, export events, and purchase events.
  3. All collected data is handled according to Google’s privacy policies and is not used to identify individual users.

8. Changes to the Terms

The Company may revise these Terms when necessary.

The updated Terms will take effect once posted within the App or on the Company’s website.

9. Governing Law and Jurisdiction

These Terms shall be governed by the laws of Japan.

Any dispute arising from or related to these Terms or the App shall be subject to the exclusive jurisdiction of the Tokyo District Court as the court of first instance.
